Regulations on Internal Security of Enterprises and Institutions

(Adopted at the 64th executive meeting of the State Council on September 13, 2004, promulgated on September 27, 2004, and effective as of December 1, 2004)

Article 1 These Regulations are formulated in order to regulate the internal security work of enterprises and institutions (hereinafter referred to as units), protect the personal and property safety of citizens and the safety of public property, and maintain the order of work, production, operation, teaching and scientific research of the units.

Article 2 The internal security work of the unit shall implement the policy of prevention first, unit responsibility, highlighting key points, and ensuring safety.

The internal security work of the unit shall highlight the protection of the personal safety of the personnel in the unit, and the unit shall not ignore the personal safety under the pretext of economic benefits, property safety or any other pretext.

Article 3 The public security department of the State Council shall guide and supervise the internal security work of units throughout the country, and the relevant departments of the State Council that are responsible for the supervision of industries and systems shall guide and inspect the internal security work of units in their own industries and systems; the public security organs of local people's governments at or above the county level shall guide and supervise the internal security work of units in their respective administrative areas, the relevant departments of the local people's governments at or above the county level that have the responsibility of supervising the industry and system guide and inspect the internal security work of the industry and the unit of the system within their administrative area, and solve the outstanding problems in the internal security work of the unit in a timely manner.

Article 4 The local people's governments at or above the county level shall strengthen the leadership of the internal security work of the units within their administrative areas, urge the public security organs and relevant departments to perform their duties in accordance with the law, and coordinate and solve the major problems in the internal security work of the units in a timely manner.

Article 5 The main person in charge of the unit shall be responsible for the internal security work of the unit.

Article 6 Units shall, in accordance with the needs of internal security and defense work, set up security and defense institutions or allocate full-time or part-time security and defense personnel.

Key units of public security shall set up public security organs suitable for the tasks of public security and security, be equipped with full-time public security personnel, and report the establishment and staffing of public security organs to the competent public security organ for the record.

Article 7 The requirements for the internal security work of a unit are:

(I) have internal security systems, measures and necessary security prevention facilities adapted to the specific conditions of the unit;

The security situation within the scope of the (II) unit is inspected, important parts are protected, and hidden dangers of security are investigated in a timely manner;

The hidden dangers and problems of public security within the scope of (III) units are dealt with in a timely manner, and public security cases and suspected criminal cases are dealt with in a timely manner.

Article 8 The internal security system formulated by a unit shall include the following contents:

(I) guard, duty, inspection system;

Safety management system for (II) work, production, operation, teaching, scientific research and other places;

(III) the safety management system for the use, safekeeping, storage and transportation of cash, bills, seals, securities and other important articles;

(IV) the internal fire control and traffic safety management system of the unit;

(V) security prevention education and training system;

(VI) system for reporting public security cases and suspected criminal cases within the unit;

(VII) the inspection, assessment, reward and punishment system for public security work;

(VIII) units that store explosive, flammable, radioactive, toxic, infectious, corrosive and other dangerous substances, as well as infectious bacteria and viruses, as well as weapons and ammunition, should also have corresponding safety management systems;

(IX) other relevant security systems.

The internal security system formulated by the unit shall not conflict with the provisions of laws, regulations and rules.

Article 9 The internal security personnel of a unit shall receive training and assessment on relevant legal knowledge, public security operations, skills and relevant professional knowledge.

Article 10 The internal security personnel of a unit shall perform their duties in accordance with law and in a civilized manner, and shall not infringe upon the legitimate rights and interests of others. The performance of duties by public security personnel in accordance with the law shall be protected by law.

Article 11 The internal security organs and security personnel of a unit shall perform the following duties:

(I) carry out publicity and education on public security prevention, and implement the internal public security system and public security prevention measures of the unit;

(II) check the certificates of personnel entering the unit and register the articles and vehicles entering and leaving the unit as required;

(III) conduct security prevention patrols and inspections within the scope of the unit, and establish records of patrols, inspections and rectification of security hidden dangers;

(IV) maintain the public security order within the unit, stop illegal acts that occur in the unit, and immediately report to the police for illegal acts that are difficult to stop, as well as public security cases and suspected criminal cases, and take measures to protect the scene, and cooperate with the public security organs in the investigation and disposal work;

(V) supervise and implement the construction and maintenance of security prevention facilities within the unit.

Article 12 Personnel within the scope of management of a unit shall abide by the internal security system of the unit.

Article 13 Units that have a bearing on the national economy and people's livelihood, national security and public security of the whole country or the regions where they are located are key units for public security. The key units of public security shall be proposed by the public security organs of the local people's governments at or above the county level in accordance with the following scope and reported to the people's governments at the corresponding levels for determination:

(I) radio stations, television stations, news agencies and other important news units;

(II) airports, ports, large stations and other important transport hubs;

(III) research and development and production units of important products of the national defense science and technology industry;

(IV) telecommunications, postal and financial units;

(V) large energy and power facilities, water conservancy facilities and urban water, electricity, gas and heat supply facilities;

(VI) large material reserve units and large commercial and trade centers;

(VII) education, scientific research, medical institutions and large cultural and sports venues;

(VIII) museums, archives and key cultural relics protection units;

Units that (IX) the development, production, sale and storage of dangerous substances or the experiment and preservation of infectious bacteria and viruses;

(X) national key construction project units;

(11) Other units that need to be listed as key points of public security. The key units of public security and security shall abide by the general provisions of these regulations on the work of public security and security and the special provisions on the key units of public security and security.

Article 14 Key units of public security and security shall determine the important parts of public security and security of their units, set up necessary technical prevention facilities for the important parts in accordance with relevant national standards, and implement key protection.

Article 15 Key units of public security shall, under the guidance of the public security organs, formulate plans for the handling of public security emergencies within the units and conduct regular drills.

Article 16 The public security organs shall perform the following duties in the internal security work of the units within their respective administrative areas:

(I) and guide units to formulate and improve internal security systems, implement security precautions, and guide the construction of security personnel and security institutions in key security units;

(II) inspect and guide the internal security work of the unit, and if it is found that the unit has violated the provisions of these regulations or hidden dangers of public security, it shall promptly issue a rectification notice and order rectification within a time limit;

(III) receiving reports of public security cases and suspected criminal cases within the unit, they will promptly send out the police and deal with them in accordance with the law.

Article 17 The relevant people's governments, public security organs and relevant departments shall commend and reward the units and individuals that have conscientiously implemented public security precautions, strictly implemented the public security work system, and made outstanding achievements in the internal security work of the units.

Article 18 If the public security personnel of a unit are disabled or die as a result of performing public security duties, they shall be given corresponding treatment in accordance with the provisions of the State on industrial injury insurance, assessment of disability and approval of martyrs.

Article 19 if a unit violates the provisions of these regulations and has hidden dangers of public security, the public security organ shall order it to make rectification within a time limit and impose a warning; if the unit fails to make rectification within the time limit, causing personal injury to citizens, loss of public or private property, or seriously threatening the personal safety of citizens, the safety of public or private property or public safety, the unit shall be fined not less than 10000 yuan but not more than 100000 yuan, the main person in charge of the unit and other persons directly responsible shall be fined between 500 yuan and 5000 yuan, and relevant organizations may be advised to impose sanctions on the main person in charge of the unit and other persons directly responsible according to law; if the circumstances are serious and constitute a crime, criminal responsibility shall be investigated according to law.

Article 20 If the security guards of a unit infringe upon the legitimate rights and interests of others in the performance of their duties, they shall make an apology, and if they cause damage to others, the unit shall be liable for compensation. After making compensation, the unit shall have the right to order the security guards who have caused the infringement due to intentional or gross negligence to bear part or all of the compensation costs; the unit shall impose sanctions on the security guards who have caused the infringement due to intentional or gross negligence. If the acts of public security personnel infringing upon the legitimate rights and interests of others are instigating or coerced by the person in charge of the unit, the person in charge of the unit shall be punished according to law and shall be liable for compensation; if the circumstances are serious and constitute a crime, criminal responsibility shall be investigated according to law.

Article 21 If a public security organ fails to perform its duties according to law after receiving a report from a unit, resulting in losses to the person, property and public property of citizens, or other acts of dereliction of duty or abuse of power, the person in charge directly responsible and other persons directly responsible shall be given administrative sanctions according to law; if the circumstances are serious and constitute a crime, criminal responsibility shall be investigated according to law.

If the relevant departments of the people's government that have the responsibility of supervising the industry and system commit dereliction of duty or abuse of power in the process of guiding and inspecting the internal security work of the units of the industry and the system, they shall be punished with reference to the provisions of the preceding paragraph.

Article 22 The internal security work of organs and organizations shall be carried out with reference to the relevant provisions of these Regulations.

Specific regulations on the work of public security in institutions of higher learning shall be formulated separately by the State Council.

Article 23 These Regulations shall enter into force as of December 1, 2004.
